 OFFICIAL RULES
The IT Professional Survey Sweepstakes (“Sweepstakes”) is an international sweepstakes open to eligible individuals who provide computer use information in an online survey. The Sweepstakes is sponsored by ClickStream Technologies, 2140 Shattuck Ave., Suite 810, Berkeley, CA, USA, 94704-1229 ("Sponsor"). Sweepstakes Participants, as defined below, will be entered into a drawing. Thirty winners (“Prize Winners”) will be randomly chosen by Sponsor to each receive one (1) Amazon.com gift certificate worth $100USD (“Prize”). NO PURCHASE NECESSARY.
1. Timing: The Sweepstakes begins at 8:00AM (PST), October 2, 2007. All entries must be completed no later than 11:59PM (PST), October 30, 2007.
2. Eligibility: The Sweepstakes is open to residents of the United States, Japan, and EU member countries who are 18 years of age or older or who have attained the age of majority in their respective states or countries, and is open to individuals who are citizens or working or studying under a valid visa/permit in the 50 United States (including Washington D.C.). Residents of Puerto Rico or jurisdictions prohibiting such promotions should consider this offer void. Only natural persons are eligible to participate in this Sweepstakes; corporate entities and the like are ineligible. Eligible individuals are “Sweepstakes Participants.” Employees, independent contractors, officers, and directors of Sponsor, its affiliates, advertising and promotion agencies, legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Sweepstakes. The Sweepstakes is not open to individuals, or immediate family members of individuals, who are employed by a market research firm or involved in market research of any kind. Individuals who do not meet certain employment, education, and computer-use standards as defined by Sponsor and programmed into the SCH3 Screener survey are not eligible to participate in the Sweepstakes. All federal, state, provincial, and local laws and regulations apply. In the event this Sweepstakes is compromised in any way, electronically or otherwise, that is beyond the control of Sponsor, Sponsor reserves the right to withdraw the transmission of this Sweepstakes.
3. How to Enter: Individuals must direct their internet browser to the SCH3 Screener survey located at
http://survey.clickstreamtech.com/SCH3.html
Individuals must complete the SCH3 Screener survey, and provide answers which meet the eligibility criteria as defined by Sponsor and programmed in the SCH3 Screener survey. Sweepstakes Participants who complete the aforementioned requirements will be officially entered into the Sweepstakes upon completion of the survey.
4. Prizes: Thirty Prize Winners will be randomly selected by Sponsor—ten from the 400 Sweepstakes Participants residing in the United States, ten from the 200 Sweepstakes Participants residing in Japan, and ten from the 200 Sweepstakes participants residing in the European Union—each to receive one (1) Amazon.com gift certificate worth $100USD. No alternative prize, cash, or other substitution is allowed. The Prize is non-assignable/non-transferable. The gift certificate must be issued in the name of a Sweepstakes Participant. The odds of winning are 1 in 40 for Sweepstakes Participants residing in the United States, 1 in 20 for Sweepstakes Participants residing in the European Union, and 1 in 20 for Sweepstakes Participants residing in Japan. All applicable federal, state, provincial, and local taxes, if any, are the responsibility exclusively of the winners.
5. Notification: The prizes will be awarded and Prize Winners will be notified between October 30 and November 15, 2007. All notified potential winners are subject to verification of eligibility and compliance with the Official Rules. Upon final verification, each potential Prize Winner will be notified by e-mail and will have ten (10) days from receipt of notification to accept the prize by e-mail. If a selected winner cannot be contacted, is ineligible, fails to acknowledge winning status within the specified time frame, or fails to comply with any term or condition of these Official Rules, the potential winner will be deemed to have forfeited the prize and an alternate potential winner may be selected.
6. General Terms and Conditions:
• Sponsor is not responsible for and shall not be liable for: (i) late, delayed, incomplete, or misdirected Entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind (iii) failed, incomplete, partial, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of a prize, or acceptance, possession, or use of a prize, or from participation in the Sweepstakes; (vi) any printing or typographical errors in any materials associated with the Sweepstakes; (vii) any regional, state, or local laws or regulations violated during the creation of the Entries by the Sweepstakes Participant(s).
• Sponsor reserves the right to suspend, cancel, or modify the Sweepstakes if fraud or technical failure corrupts the administration, security, or proper conduct of the Sweepstakes, as determined by Sponsor in its sole discretion.
• Sponsor shall not be responsible for acts and omission of services connected with the prizes. Not limiting the foregoing, each Sweepstakes Participant agrees to release and hold Sponsor harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Sweepstakes, including without limitation any injury resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based upon intellectual property infringement, publicity rights, defamation, or invasion of privacy.
• Each Sweepstakes Participant agrees that Sponsor's only obligation is to accept Entries from eligible Sweepstakes Participants according to the procedures and criteria set forth in these Official Rules, and award the prize set forth herein to the winner, subject to the terms and conditions herein. Sweepstakes Participant agrees that Sponsor's obligation is acceptance for any Entry submitted, and that Sweepstakes Participant is not entitled to and shall not seek any further compensation. In the event of disputes, all entries are deemed to have been made by the holder of the e-mail account associated with the entry.
• Each Sweepstakes Participant is subject to the Sponsor’s Privacy Policy.
• Each Sweepstakes Participant agrees that by submitting an Entry, he or she allows for the use of his or her survey answers without compensation. Sponsor will also be collecting Sweepstakes Participants’ email addresses. The email addresses will be held by Sponsor for the duration of the Sweepstakes and thereafter for fulfillment of prizes and for future communication about ClickStream Technologies’ surveys. The email addresses will not be shared with other companies. The Sweepstakes Participant has a right of access to and of modification and withdrawal of that person’s own email address. The data controller and the recipient of the data is ClickStream Technologies, 2140 Shattuck Ave., Suite 810, Berkeley, CA, USA, 94704-1229. Except for compulsory rules of local law prevailing over the following choice of law provision, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Sweepstakes Participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of California, USA, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
7. Winners List: A winners list will be posted on the ClickStream Technologies website,
http://www.clickstreamtech.com/sch3/winners by November 15, 2007.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
